1. Acceptance of Terms

By accessing or using the HotelBooking platform ("Service"), including our website, booking widget, and messaging services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service.

2. Description of Service

HotelBooking provides a hotel management and booking platform that enables boutique hotels to accept reservations, manage operations, and communicate with guests via email and SMS. The Service is provided to both hotel operators ("Hotels") and their guests ("Guests").

3. Guest Bookings

When making a booking through the Service:

  • You agree to provide accurate and complete information.
  • Bookings are subject to the individual hotel's availability, policies, and cancellation terms as displayed at the time of booking.
  • Payment processing is handled securely through the hotel's configured payment provider, which may include Stripe or PayPal. We do not store full card details.
  • Booking confirmations and related communications will be sent to the email address and/or phone number you provide.

4. SMS/Text Messaging Terms

By providing your phone number and opting in to receive text messages during the booking process, you expressly consent to receive SMS messages from the hotel where you made your reservation, sent through the HotelBooking platform. You understand and agree to the following:

  • Types of messages: You will receive transactional SMS messages related to your hotel booking, including booking confirmations, check-in/check-out reminders, pre-arrival information, and post-stay follow-ups.
  • Message frequency: Message frequency varies. You will typically receive 1-5 messages per booking.
  • Costs: Message and data rates may apply. Contact your wireless carrier for details about your messaging plan.
  • Opt-out: You may opt out of receiving SMS messages at any time by texting STOP to any message you receive from us. After opting out, you will receive a final confirmation message and will no longer receive SMS messages from us unless you opt in again.
  • Opt-in: You may opt back in to SMS messages by texting START or by providing your consent during a future booking.
  • Help: For assistance with SMS messaging, text HELP to any message or contact us at support@hotelbooking.app.
  • No sharing: Your consent to receive SMS messages is not a condition of any purchase. We will not sell, rent, or share your phone number or opt-in consent with any third party for marketing purposes.
  • Supported carriers: Compatible with all major US carriers. Carriers are not liable for delayed or undelivered messages.

5. User Accounts

Hotel operators who create accounts on the platform are responsible for maintaining the confidentiality of their login credentials and for all activity under their account. You agree to notify us immediately of any unauthorized access.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Submit false or misleading information.
  • Interfere with the operation of the Service.
  • Attempt to access accounts or data belonging to other users.
  • Use the messaging features to send spam or unsolicited messages.

7. Intellectual Property

The Service, including its design, features, and content, is owned by HotelBooking and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our prior written consent.

8. Limitation of Liability

The Service is provided "as is" without warranties of any kind. To the fullest extent permitted by law, HotelBooking shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

HotelBooking is not responsible for the fulfillment of hotel bookings, the quality of hotel services, or disputes between guests and hotels. Such matters are between the guest and the hotel.

9. Cancellation & Refunds

Cancellation and refund policies are set by each individual hotel. Please review the hotel's cancellation policy displayed at the time of booking. Refunds, when applicable, are processed through the original payment method used for the booking.

10. Modifications

We reserve the right to modify these Terms at any time. Material changes will be posted on this page with an updated date. Continued use of the Service after changes constitutes acceptance of the modified Terms.

11. Governing Law

These Terms are governed by the laws of the State of New York, United States, without regard to conflict of law principles.
